Entry on a national visa\n            (&sect;&nbsp;6&nbsp;AufenthG) &mdash; purpose-specific, applied\n            for at the competent German mission abroad before arrival. Then\n            the first residence permit (Aufenthaltserlaubnis,\n            &sect;&nbsp;7&nbsp;AufenthG) &mdash; purpose-specific, issued by\n            the immigration authority (Ausl&auml;nderbeh&ouml;rde) in\n            Germany. Then, before expiry: extension.<\/p>\n            <p>The most common error is not in the application itself but in\n            the starting point. A person who enters on a visa for the wrong\n            purpose may later face difficulties explaining why the actual\n            employment, activity or family situation does not match the title\n            originally granted.<\/p>\n\n            <h2 id=\"erp-fiktion\">The Fiktionsbescheinigung &mdash; Continued\n              Lawful Residence During Processing<\/h2>\n            <p>Where an extension or a new title is applied for before the\n            existing permit expires, &sect;&nbsp;81(4)&nbsp;AufenthG provides\n            that the existing title continues in force until the authority\n            decides. The legal effect arises from the timely application. The\n            Fiktionsbescheinigung under &sect;&nbsp;81(5)&nbsp;AufenthG is\n            the certificate that merely documents this effect.<\/p>\n            <p>Whether employment, self-employment, or other activity remains\n            permitted during the fictitious continuance period depends on the\n            title originally held and the conditions attached to it. The\n            Fiktionsbescheinigung should be checked carefully for its wording\n            on employment, self-employment or other permitted activities.\n            Employers often need this wording for right-to-work\n            documentation.<\/p>\n            <p>If an application is made only after the permit has already\n            expired, automatic fictitious continuation is generally at risk.\n            This can affect lawful residence, employment permission and later\n            steps toward settlement or citizenship. Late applications should\n            be assessed immediately. In Hamburg, appointment availability and\n            processing times can be significant. The extension should\n            therefore be prepared well before expiry.<\/p>\n\n            <h2 id=\"erp-requirements\">What the Extension Requires under\n              &sect;&nbsp;8 AufenthG<\/h2>\n            <p>Under &sect;&nbsp;8&nbsp;AufenthG, extension generally follows\n            the rules applicable to the original issuance of the residence\n            permit, unless the Residence Act provides otherwise. The authority\n            will usually check whether the original purpose of stay still\n            exists and whether the applicant continues to meet the\n            title-specific requirements.<\/p>\n            <p>For an employment permit, that means the specific employment\n            must still be in place or a new qualifying employment must be\n            documented. For a study permit: enrolment must continue. For a\n            family reunion permit: the reference person&rsquo;s status must\n            be stable and the income and housing conditions met.<\/p>\n            <p>Common issues in practice include salary below the applicable\n            Blue Card threshold at the time of renewal; change of employer or\n            role without required notification or assessment; study\n            interrupted without informing the authority; family reference\n            person whose own status has changed. Each of these can complicate\n            the extension or lead to a refusal.<\/p>\n\n            <h2 id=\"erp-change\">Change of Purpose &mdash; When the Situation\n              Changes<\/h2>\n            <p>A change of purpose (Zweckwechsel) becomes relevant whenever\n            the original purpose of stay no longer fits the actual situation.\n            A skilled worker who becomes self-employed, a student who\n            completes their degree and wants to work, a spouse who wants to\n            remain independently after separation &mdash; in all these cases,\n            the existing permit generally no longer covers the new purpose.<\/p>\n            <p>A change of purpose is not merely an administrative update; it\n            can mean that an entirely different residence title with different\n            requirements is needed. It should be applied for and assessed\n            before the new activity begins or the new purpose is implemented\n            in practice.<\/p>\n            <p>Some changes of purpose can be handled in Germany; others may\n            require a new visa procedure from abroad. The correct route\n            depends on the current title, the intended new title, and the\n            statutory exceptions. The abolition of the\n            remonstration procedure concerns visa refusals by German missions\n            abroad. A refusal of a residence permit extension by a German\n            immigration authority is a domestic administrative decision; the\n            available remedies, deadlines and possible interim relief must be\n            checked from the decision itself. Depending on the refusal\n            grounds, a new application with improved evidence or court\n            proceedings before the competent administrative court may be\n            appropriate. The window for appeal or application for interim\n            relief can be short.
