Like the\n            Niederlassungserlaubnis, it is not tied to a specific employment\n            relationship or purpose of stay and generally permits gainful\n            employment. Its legal basis is EU Directive 2003\/109\/EC, the\n            Long-Term Residents Directive.<\/p>\n            <p>The decisive advantage over a purely national title is its EU\n            dimension. The Daueraufenthalt-EU may facilitate subsequent\n            residence in other participating EU Member States for the purpose\n            of employment, study, or other activity &mdash; subject to the\n            national requirements of the target state. This makes it relevant\n            for internationally mobile professionals who wish to keep the\n            option of cross-EU movement open.<\/p>\n\n            <h2 id=\"eltrp-requirements\">Requirements under\n              &sect;&nbsp;9a AufenthG<\/h2>\n            <p>The requirements under &sect;&nbsp;9a&nbsp;AufenthG largely\n            parallel those of the standard settlement permit, with one\n            significant difference regarding pension contributions.<\/p>\n            <p>The conditions to be assessed include five years of lawful\n            residence with a residence permit, secured livelihood through\n            fixed and regular income, sufficient German language skills\n            (usually B1), basic knowledge of the legal and social order,\n            adequate housing, and no grounds of public security or order that\n            prevent the grant.<\/p>\n            <p>Unlike the standard route under &sect;&nbsp;9&nbsp;AufenthG,\n            &sect;&nbsp;9a&nbsp;AufenthG does not impose a fixed 60-month\n            pension contribution requirement. However, stable and regular\n            resources, including adequate old-age provision under\n            &sect;&nbsp;9c&nbsp;AufenthG, must still be assessed. Tax\n            compliance, health insurance, and old-age provision are all part\n            of the livelihood assessment under &sect;&nbsp;9c. For\n            self-employed persons and those with irregular income or pension\n            histories, the EU long-term permit may in some constellations\n            offer a more accessible route to indefinite status than the\n            Niederlassungserlaubnis.<\/p>\n            <p>Residence periods are counted under &sect;&nbsp;9b&nbsp;\n            AufenthG. Periods of study or vocational training may be counted\n            only partially, certain temporary-purpose stays may not count,\n            and absences from Germany or the EU can affect the calculation.\n            Individual assessment is necessary.<\/p>\n\n            <h2 id=\"eltrp-comparison\">Daueraufenthalt-EU vs\n              Niederlassungserlaubnis &mdash; Which Fits Better<\/h2>\n            <p>Both are indefinite residence titles and largely comparable\n            for many domestic purposes. The practical choice between them\n            depends primarily on two considerations.<\/p>\n            <p>First, future mobility: if subsequent residence in another EU\n            Member State is part of the long-term plan, the Daueraufenthalt-EU\n            is the more appropriate instrument. The Niederlassungserlaubnis\n            does not carry this EU-law dimension. Second, pension\n            contributions: if the 60-month pension record required under\n            &sect;&nbsp;9&nbsp;AufenthG is incomplete &mdash; particularly\n            for self-employed persons or those with career interruptions\n            &mdash; the Daueraufenthalt-EU may be worth considering, provided\n            the overall livelihood and old-age provision under\n            &sect;&nbsp;9c&nbsp;AufenthG can be demonstrated.<\/p>\n            <p>For those who plan to remain in Germany permanently and have\n            no cross-EU mobility plans, the\n            <a href=\"\/en\/settlement-permit-germany\/\">Niederlassungserlaubnis<\/a>\n            under &sect;&nbsp;9&nbsp;AufenthG (or an accelerated route under\n            &sect;&nbsp;18c or &sect;&nbsp;21(4)) is often the more\n            straightforward choice.<\/p>\n\n            <h2 id=\"eltrp-mobility\">Cross-EU Mobility under the Long-Term\n              Residents Directive<\/h2>\n            <p>The Daueraufenthalt-EU facilitates, but does not automatically\n            grant, the right to reside in another EU Member State. The\n            mechanism works as follows: a holder of an EU long-term residence\n            permit issued by Germany may apply for residence in another\n            participating Member State under national rules implementing the\n            Directive. The target Member State may still impose national\n            requirements relating to employment, self-sufficiency, housing,\n            registration and integration.<\/p>\n            <p>For mobility from another EU Member State to Germany,\n            &sect;&nbsp;38a&nbsp;AufenthG is the German implementation route\n            for holders of long-term resident status in another Member State.\n            For holders of a German Daueraufenthalt-EU who wish to move to\n            another Member State, the law of the target state and the\n            Directive&rsquo;s mobility rules must be checked.<\/p>\n            <p>Two Member States do not participate in the Directive at all:\n            Ireland and Denmark. A move to either of those states cannot be\n            facilitated by the Daueraufenthalt-EU. The practical relevance of\n            the cross-EU mobility option should be assessed specifically for\n            the intended target state before the Daueraufenthalt-EU is chosen\n            over the Niederlassungserlaubnis on this basis alone.<\/p>\n\n            <h2 id=\"eltrp-procedure\">The Application Procedure<\/h2>\n            <p>Applications in Hamburg are filed with the competent\n            immigration authority. The exact unit and appointment route should\n            be checked before filing. Appointment availability and processing\n            times in Hamburg can be significant and should be planned for in\n            advance. Where the existing residence permit expires during the\n            procedure, timely action to preserve lawful status through\n            extension or fictitious continuation under\n            &sect;&nbsp;81(4)&nbsp;AufenthG is essential.<\/p>\n\n            <h2 id=\"eltrp-citizenship\">From EU Long-Term Residence to\n              Citizenship<\/h2>\n            <p>The Daueraufenthalt-EU can generally serve as a suitable\n            residence title for naturalisation where the StAG requirements\n            are met. Both titles can generally serve as a suitable residence\n            basis for naturalisation where the StAG requirements are met.\n            Since the StARModG (in force since 27&nbsp;June 2024), the\n            standard naturalisation period is five years, and dual citizenship\n            is generally permitted. Where long-term residence in Germany is\n            planned, both the settlement permit and citizenship should be\n            considered together from the outset.
