A claim that may be\n            time-barred should be assessed carefully: limitation does not\n            extinguish the claim automatically, but the debtor may raise\n            it as a defence.<\/p>\n            <p>Default (Verzug) under &sect;&nbsp;286 BGB triggers\n            entitlement to default interest. Once the debtor is in\n            default, the creditor may also be able to recover necessary\n            and reasonable legal pursuit costs caused by the default.<\/p>\n            <p>For payment claims where the debtor is not a consumer, the\n            creditor may also be entitled to the &euro;40 lump-sum\n            compensation under &sect;&nbsp;288(5) BGB. The lump sum is\n            credited against further damages insofar as those damages\n            consist of legal pursuit costs.<\/p>\n            <p>In B2B payment claims, default interest under\n            &sect;&nbsp;288(2) BGB is nine percentage points above the\n            base rate. The base rate is adjusted twice a year.<\/p>\n\n            <h2 id=\"dc-demand\">Demand Letter<\/h2>\n            <p>A formal demand letter (Mahnung) is the standard first\n            step for a due and unpaid monetary claim. It identifies the\n            claim, states the amount due, sets a deadline for payment,\n            and creates a basis for default, interest and cost claims.\n            A demand letter does not generally suspend limitation.\n            Limitation may be suspended, for example, by negotiations\n            under &sect;&nbsp;203 BGB, by filing and serving a claim,\n            or by service of a Mahnbescheid under &sect;&nbsp;204 BGB.\n            Where limitation is approaching, the procedural step\n            required to suspend it must be taken in time.<\/p>\n\n            <h2 id=\"dc-mahnverfahren\">The Judicial Dunning Procedure\n              &mdash; Mahnverfahren<\/h2>\n            <p>The Mahnverfahren allows a creditor to seek a payment\n            order without an examination of the merits at the initial\n            stage. The court primarily reviews the formal requirements\n            of the application. The national German Mahnverfahren is\n            available for claims seeking payment of a specified sum in\n            euros. The procedure is particularly efficient where no\n            substantive opposition is expected. Where the claim is\n            already seriously contested, direct litigation may be more\n            efficient.<\/p>\n            <p>The application is filed with the central dunning court\n            (Mahngericht). For applicants with their registered office\n            or residence in Hamburg or Mecklenburg-Western Pomerania,\n            the central Mahngericht is the Amtsgericht Hamburg-Altona.<\/p>\n            <p>The Mahnbescheid states a two-week period for payment or\n            opposition. If no opposition is filed, the creditor can\n            apply for a Vollstreckungsbescheid after the statutory\n            waiting period. The Vollstreckungsbescheid is an enforceable\n            title; the debtor can still lodge an objection against it\n            within the applicable period, which can lead to ordinary\n            contentious proceedings. If the debtor opposes the\n            Mahnbescheid, the claim is not decided in the Mahnverfahren.\n            Upon application and payment of the required further court\n            costs, the matter can be transferred to the competent court\n            for ordinary litigation; costs incurred in the Mahnverfahren\n            are credited against the litigation proceedings.<\/p>\n\n            <h2 id=\"dc-enforcement\">Enforcement<\/h2>\n            <p>Once a Vollstreckungsbescheid or a court judgment becomes\n            final, enforcement (Zwangsvollstreckung) can be initiated.\n            Available enforcement measures include wage or salary\n            attachment, bank account attachment, attachment of\n            receivables, forced administration or sale of real property,\n            and seizure of movable assets through the enforcement\n            officer (Gerichtsvollzieher). The debtor can also be\n            required to provide information about their assets in a\n            statutory declaration (Verm\u00f6gensauskunft).<\/p>\n            <p>The appropriate enforcement measure depends on the\n            available information about bank accounts, employment,\n            receivables, movable assets and other recoverable property.\n            An enforceable title can have long-term value, but immediate\n            recovery still depends on the debtor&rsquo;s assets,\n            solvency and any insolvency proceedings.<\/p>\n\n            <h2 id=\"dc-courts\">Where Court Proceedings Are More\n              Suitable<\/h2>\n            <p>Where a substantive objection is expected, or where the\n            claim requires extensive factual or legal presentation,\n            ordinary litigation may be the more efficient route. As a\n            rule, the Amtsgericht handles civil claims up to\n            &euro;10,000 and the Landgericht handles claims above that\n            threshold, subject to statutory exceptions. At the\n            Landgericht, a Kammer f&uuml;r Handelssachen may hear\n            qualifying commercial disputes where the statutory\n            requirements are met and the appropriate procedural request\n            is made.<\/p>\n            <p>Hamburg has also established a Commercial Court at the\n            Hanseatic Higher Regional Court for qualifying high-value\n            commercial disputes from &euro;500,000, as well as\n            Commercial Chambers at the Hamburg Regional Court for\n            certain commercial matters. English-language proceedings\n            are available in qualifying cases. Further detail is on our\n            <a href=\"\/en\/contract-disputes-germany\/\">contract disputes\n            page<\/a>.<\/p>\n\n            <h2 id=\"dc-european\">European Order for Payment<\/h2>\n            <p>The European Order for Payment Procedure under Regulation\n            (EC) No&nbsp;1896\/2006 is available for cross-border civil\n            and commercial monetary claims within the EU (except\n            Denmark). The application is made on a standard form and\n            does not require a court hearing at the initial stage. The\n            court primarily checks formal requirements. The claim must\n            be for a specific sum and arise from civil or commercial law.\n            <\/p>\n            <p>The debtor has 30&nbsp;days to oppose the European Payment\n            Order. If no opposition is filed, the order is declared\n            enforceable and can be enforced in participating member\n            states without a separate recognition procedure. Where\n            opposition is filed, the matter can be continued or the\n            application may lapse depending on the creditor&rsquo;s\n            choice.<\/p>\n            <p>The European Small Claims Procedure under Regulation (EC)\n            No&nbsp;861\/2007 covers cross-border civil and commercial\n            claims up to &euro;5,000 (excluding interest, costs, and\n            expenses). It is a separate cross-border court procedure and\n            is not limited to entirely uncontested claims.<\/p>\n\n            <h2 id=\"dc-foreign\">For Foreign Creditors<\/h2>\n            <p>Foreign creditors can use German debt collection\n            procedures where German courts have international\n            jurisdiction. For applicants without a general place of\n            jurisdiction in Germany, the competent national dunning\n            court is generally the Amtsgericht Wedding in Berlin. The\n            claim in the national Mahnverfahren must be stated in euros,\n            and the court language is German. Where the debtor is based\n            abroad, the availability of the German Mahnverfahren depends\n            on German international jurisdiction and on whether service\n            abroad is permitted under the applicable procedural\n            framework; the European Order for Payment or proceedings in\n            the debtor&rsquo;s state may be more suitable.
