The relevant instruments include\n          residence titles such as &sect;&sect;&nbsp;18a, 18b, 18g, 19, 19c,\n          20a, and 21&nbsp;AufenthG, as well as procedural routes such as\n          the fast-track skilled worker procedure under\n          &sect;&nbsp;81a&nbsp;AufenthG. Each of these serves a different\n          constellation. The right starting point depends on the\n          applicant&rsquo;s role, qualification, salary, employment\n          structure, and long-term plans.<\/p>\n          <p>All of these provisions were substantially expanded by the\n          Fachkr&auml;fteeinwanderungsgesetz (FEG) in three reform stages:\n          November 2023 (Pillar 1: qualified employment, Anerkennungspartnerschaft),\n          March 2024 (Pillar 2: recognition partnership under\n          &sect;&nbsp;16d&nbsp;AufenthG), June 2024 (Pillar 3: Opportunity\n          Card under &sect;&nbsp;20a&nbsp;AufenthG).<\/p>\n\n          <h2 id=\"bi-tracks\">Three Advisory Tracks<\/h2>\n          <p>Three main advisory tracks can be distinguished depending on the\n          starting situation.<\/p>\n          <p><strong>Track 1 &mdash; Employers:<\/strong> Companies that want\n          to hire or transfer qualified staff from abroad must identify the\n          correct residence title, check whether qualification recognition is\n          required, and ensure that the employment contract and job\n          description meet the immigration authority&rsquo;s requirements.\n          Since 1&nbsp;January 2026, &sect;&nbsp;45c&nbsp;AufenthG requires\n          certain employers in Germany who hire third-country nationals from\n          abroad for work in Germany to provide information, in text form,\n          about advisory services under &sect;&nbsp;45b&nbsp;AufenthG,\n          including the nearest advisory centre. Separately, employers must\n          check before employment begins whether the residence title permits\n          the specific employment and should document the right to work during\n          the employment relationship.<\/p>\n          <p><strong>Track 2 &mdash; Skilled workers:<\/strong> Qualified\n          persons from non-EU countries who wish to work in Germany face a\n          choice between several titles &mdash; EU Blue Card, skilled worker\n          visa, ICT Card, or the Opportunity Card as a preliminary step.\n          Which route applies depends on qualification, salary, and whether\n          a job offer is already in place.<\/p>\n          <p><strong>Track 3 &mdash; Entrepreneurs, self-employed persons,\n          and managing directors:<\/strong> Those who wish to found or run a\n          business in Germany, or who act as managing directors, need either\n          a &sect;&nbsp;21&nbsp;AufenthG residence permit for self-employed\n          activity or &mdash; depending on their role &mdash; a\n          &sect;&nbsp;19c&nbsp;AufenthG title. For managing directors, the\n          correct route depends on the role: employed managing directors or\n          corporate officers may fall under &sect;&nbsp;19c&nbsp;AufenthG in\n          conjunction with the Employment Ordinance. Entrepreneurial\n          shareholder-managing directors who operate the business in a\n          self-employed capacity may instead require a\n          &sect;&nbsp;21&nbsp;AufenthG assessment.<\/p>\n          <p>In practice, these tracks frequently overlap. A managing\n          director needs not only a residence permit but also the right\n          corporate structure. An employer asks not only about the permit but\n          also about the employment contract, salary compliance, and\n          &sect;&nbsp;45c&nbsp;obligations. A skilled worker on the Blue Card\n          may later want to move into self-employment. The process begins with identifying\n          the correct residence title, checking whether qualification\n          recognition is required, and ensuring that the employment contract\n          and job description meet the immigration authority&rsquo;s\n          requirements. The fast-track procedure under\n          &sect;&nbsp;81a&nbsp;AufenthG can compress the overall timeline by\n          coordinating recognition, Federal Employment Agency consent, and\n          the visa procedure in parallel.<\/p>\n          <p>Since 1&nbsp;January 2026, &sect;&nbsp;45c&nbsp;AufenthG\n          requires certain employers in Germany who hire third-country\n          nationals from abroad for work in Germany to provide information,\n          in text form, about advisory services under\n          &sect;&nbsp;45b&nbsp;AufenthG, including the nearest advisory\n          centre. Separately, employers must check before employment begins\n          whether the residence title permits the specific employment and\n          should document the right to work during the employment\n          relationship.<\/p>\n\n          <h2 id=\"bi-skilled\">For Skilled Workers, Managing Directors, and\n            Entrepreneurs<\/h2>\n          <p>For skilled workers, the starting question is whether a job\n          offer is already in place. Where the salary and qualification\n          requirements are met, the EU Blue Card is often the stronger\n          long-term route because of the shorter settlement permit pathway\n          and favourable family reunification conditions. Where the salary\n          falls below the Blue Card threshold, the skilled worker visa under\n          &sect;&sect;&nbsp;18a or 18b applies. Without a job offer yet, the\n          Opportunity Card under &sect;&nbsp;20a&nbsp;AufenthG allows entry\n          to search for qualifying employment.<\/p>\n          <p>For managing directors and entrepreneurs, the right route\n          depends on the role. Employed managing directors or corporate\n          officers may fall under &sect;&nbsp;19c&nbsp;AufenthG in\n          conjunction with the Employment Ordinance. The residence permit\n          under &sect;&nbsp;21&nbsp;AufenthG is relevant for self-employed\n          persons, entrepreneurs, founders, and active investors. A purely\n          passive capital investment is generally not sufficient; the\n          business activity, financing, economic substance, and the\n          applicant&rsquo;s personal role in Germany must each be\n          assessed.<\/p>\n\n          <h2 id=\"bi-2026\">Developments 2026<\/h2>\n          <p>Several developments are relevant for business immigration in\n          2026. The EU Blue Card salary thresholds are &euro;50,700\n          (standard) and &euro;45,934.20 (shortage occupations and career\n          starters) as of June 2026. The recognition partnership under\n          &sect;&nbsp;16d&nbsp;AufenthG (in force since March 2024) allows\n          entry before recognition is complete where a qualifying employment\n          contract and written employer agreement are in place. The\n          &sect;&nbsp;45c&nbsp;AufenthG employer information obligation has\n          been in force since 1&nbsp;January 2026.<\/p>\n          <p>The settlement permit pathway for skilled workers under\n          &sect;&sect;&nbsp;18a and 18b has been shortened to 36&nbsp;months\n          since March 2024. A shorter 24-month pathway may apply where the\n          skilled worker completed vocational training or a degree in\n          Germany. The Opportunity Card under &sect;&nbsp;20a&nbsp;AufenthG\n          has been in force since June 2024.<\/p>\n          <p>For certain economic residence titles &mdash; including the EU\n          Blue Card, skilled worker titles under &sect;&sect;&nbsp;18a and\n          18b AufenthG, ICT and Mobile ICT Cards, certain\n          &sect;&nbsp;19c constellations, and &sect;&nbsp;21 AufenthG\n          &mdash; parent and parent-in-law reunification may be possible\n          under &sect;&nbsp;36(3)&nbsp;AufenthG where the relevant\n          residence title was first issued on or after 1&nbsp;March 2024.\n          This is not a general right for all residence permit holders and\n          must be assessed carefully in the individual case.<\/p>\n\n          <h2 id=\"bi-integrated\">Integrated Advisory from One Mandate<\/h2>\n          <p>Business immigration regularly requires a view beyond the\n          residence permit itself. Whether a residence permit fits the\n          managing director depends also on how the company is structured.\n          Whether a skilled worker can be hired long-term depends also on the\n          employment contract, salary, and qualification recognition. Whether\n          a company formation meets the immigration requirements depends also\n          on its corporate substance.<\/p>\n          <p>We combine immigration law advice with corporate law and\n          employment law where the situation calls for it.
