It is designed for professionals employed by a company\n          outside the EU who are to be transferred temporarily to a subsidiary,\n          branch, or establishment of the same corporate group in Germany.<\/p>\n          <p>The permit is based on EU Directive 2014\/66\/EU on intra-corporate\n          transfers, implemented in Germany through &sect;&nbsp;19 AufenthG.\n          It applies to three categories of transferee: managers, specialists\n          with specialised knowledge, and &mdash; under stricter conditions\n          &mdash; trainees within a structured training programme. The\n          intra-corporate transfer to Germany must be intended to exceed\n          90&nbsp;days.<\/p>\n          <p>The ICT Card differs from other employment titles in two important\n          respects. There is no fixed salary threshold comparable to the EU\n          Blue Card, and the Federal Employment Agency&rsquo;s review is\n          limited in scope. This makes it a practical instrument for\n          international groups in certain constellations &mdash; but it is a\n          specialist tool with detailed requirements that must be carefully\n          met.<\/p>\n\n          <h2 id=\"ict-eligibility\">Eligibility Requirements<\/h2>\n          <p>The conditions for the ICT Card are specific. At the time of\n          application, the employee must have been continuously employed by the\n          sending company outside the EU for at least six months. The employee\n          must remain employed by the sending undertaking or group during the\n          transfer period. The sending and receiving companies must be part of\n          the same corporate group &mdash; as parent, subsidiary, or branch.\n          The employee must qualify as a manager, specialist, or trainee. For\n          specialists, it must be demonstrated that they possess specialised\n          knowledge that is actually required by the receiving entity. The\n          professional qualification must be evidenced &mdash; formal\n          recognition of foreign qualifications is not required, but\n          qualification, function, and proposed activity must be plausibly\n          documented. The assignment in Germany is time-limited: up to three\n          years for managers and specialists, up to one year for\n          trainees.<\/p>\n          <p>Trainees are subject to additional requirements, including a\n          higher education qualification and a paid traineeship aimed at career\n          development or training in business techniques or methods.<\/p>\n          <p>A new ICT application may be barred if it is filed within six\n          months after the end of a previous stay in Germany for the purpose\n          of an intra-corporate transfer.<\/p>\n          <p>In practice, proving the corporate connection is frequently the\n          first hurdle. Group structures that are clear in the home\n          jurisdiction are not always straightforward to document for German\n          authorities. We review the document basis at an early stage, before\n          the procedure is initiated.<\/p>\n\n          <h2 id=\"ict-remuneration\">Remuneration Requirements<\/h2>\n          <p>The ICT Card carries no fixed minimum salary threshold of the kind\n          that applies to the EU Blue Card. However, the remuneration must be\n          at least equivalent to that of comparable domestic employees &mdash;\n          the equivalence principle. The appropriate comparator group depends\n          on the role and sector.<\/p>\n          <p>Variable salary components, bonuses, and allowances are assessed\n          on their actual structure. What matters is whether they constitute\n          provable remuneration for the work performed. Assignment-related\n          costs &mdash; travel, accommodation, subsistence &mdash; should not\n          be treated as guaranteed remuneration for these purposes. Allowances\n          can be relevant, but they should not be relied upon as fixed\n          remuneration unless they are contractually guaranteed and comparable\n          to salary.<\/p>\n          <p>We advise on structuring the employment contract or secondment\n          agreement to show a clearly guaranteed base salary that withstands\n          comparison with domestic employees.<\/p>\n\n          <h2 id=\"ict-ba\">Federal Employment Agency &mdash; Role in the ICT\n            Procedure<\/h2>\n          <p>The Federal Employment Agency (BA) is involved in the ICT Card\n          procedure as a rule. Consent is obtained internally during the visa\n          or residence permit process. The review is limited in scope: the BA\n          examines the classification of the employee as manager, specialist,\n          or trainee, and checks remuneration and working conditions. A classic\n          priority review does not apply.<\/p>\n          <p>BA involvement is often manageable where role, remuneration,\n          working conditions, and qualification are clearly documented. It can\n          still become a practical obstacle where the role classification or\n          salary structure is unclear.<\/p>\n\n          <h2 id=\"ict-mobility\">ICT Mobility in the EU<\/h2>\n          <p>EU mobility is one of the practical advantages of the ICT\n          framework. A holder of a German ICT Card may, under the ICT mobility\n          rules, work temporarily for the group in other participating EU\n          member states. For short stays of up to 90&nbsp;days within a\n          180-day period, notification to the competent authority in the\n          destination member state may be sufficient, depending on that member\n          state&rsquo;s rules. For longer stays, the destination member state\n          may require a mobile ICT residence title under its national\n          implementation of the ICT Directive. Ireland and Denmark are not\n          part of this system. The specific conditions vary by member state\n          and must be assessed individually.<\/p>\n          <p>The German provisions in &sect;&sect;&nbsp;19a and 19b AufenthG\n          mainly govern the reverse situation: intra-corporate transferees who\n          hold an ICT title from another EU member state and come to Germany\n          for short-term or long-term mobility.<\/p>\n\n          <h2 id=\"ict-comparison\">ICT Card vs EU Blue Card vs Skilled Worker\n            Visa<\/h2>\n          <p>The ICT Card is not the right instrument for every international\n          employment situation. It presupposes a connected corporate group\n          structure and a temporary assignment. Professionals who are to be\n          employed permanently in Germany need a different title.<\/p>\n          <p>The EU Blue Card (&sect;&nbsp;18g AufenthG) is suited to\n          academic-level professionals with a concrete job offer and a salary\n          meeting the statutory threshold (&euro;50,700 as a rule in 2026).\n          It leads more quickly to a settlement permit and carries more\n          favourable family reunification conditions. It does not require a\n          group structure.<\/p>\n          <p>Skilled worker residence permits (&sect;&sect;&nbsp;18a,\n          18b&nbsp;AufenthG) also require no group structure, but do require\n          qualification recognition and typically BA involvement. They cover\n          both vocational and academic qualification routes.<\/p>\n          <p>The ICT Card is the appropriate instrument where the group\n          structure and six-month prior employment conditions are met, the\n          assignment is temporary, and the qualification and function\n          requirements are satisfied. Where a longer-term or permanent stay is\n          anticipated, a timely switch to a different title should be\n          planned.<\/p>\n          <p>We assess which route fits the individual situation and advise on\n          the transition where relevant. The EU Blue\n          Card is one option where the qualification and salary requirements\n          are met. Skilled worker titles under &sect;&sect;&nbsp;18a or 18b\n          may be alternatives depending on qualification and role. The\n          transition should be planned well in advance of the end of the\n          maximum ICT period.<\/p>\n\n          <h2 id=\"ict-application\">Application Process and Documents<\/h2>\n          <p>The ICT Card application is submitted at the competent German\n          embassy or consulate in the employee&rsquo;s country of residence\n          as a rule. The competent immigration authority (Ausl&auml;nderbeh&ouml;rde)\n          in Germany is involved in the procedure. In Hamburg, responsibilities\n          may involve the Hamburg Welcome Center or the competent immigration\n          authority depending on the procedural stage and the applicant&rsquo;s\n          situation. The competent authority should be checked before\n          filing.<\/p>\n          <p>Documents typically required include a valid passport, evidence of\n          the corporate group connection between both companies (commercial\n          register extracts, organisational chart, corporate documents), proof\n          of six months&rsquo; prior employment with the sending company, the\n          secondment agreement or employment contract with the German entity,\n          evidence of qualifications, a job description classifying the role\n          as manager, specialist, or trainee, and remuneration documentation.\n          The competent authority may request additional documents.<\/p>\n          <p>Processing times vary considerably depending on the German mission\n          abroad, BA involvement, document quality, and the competent\n          immigration authority. Several months should be factored into the\n          planning. The fast-track procedure under &sect;&nbsp;81a AufenthG is\n          not the typical route for ICT Card applications; whether any form of\n          procedural acceleration is available should be checked with the\n          competent authority in the individual case.<\/p>\n\n          <h2 id=\"ict-family\">Family Reunification<\/h2>\n          <p>Spouses and minor children of ICT Card holders can join under the\n          family reunification provisions. As with EU Blue Card holders,\n          spouses of ICT Card and Mobile ICT Card holders are generally not\n          required to prove A1 German language skills before entry. Other\n          requirements &mdash; including livelihood, housing, and the duration\n          of the principal holder&rsquo;s permit &mdash; should still be\n          checked in the individual case.
