Private individuals with sustainable\n            non-employment income, retirees or financially independent\n            persons who pursue none of those purposes but wish to live in\n            Germany on a long-term basis appear, at first glance, to have\n            no options.<\/p>\n            <p>Germany does not have a general retirement visa.\n            &sect;&nbsp;7 AufenthG is not a general clause. The provision\n            applies only where the intended purpose is not already\n            specifically covered elsewhere in the Residence Act. Where a\n            more specific residence title fits the intended purpose &mdash;\n            for example &sect;&nbsp;21 for self-employment or\n            &sect;&sect;&nbsp;18a\/18b for skilled employment &mdash; that\n            route will usually have to be assessed first.\n            &sect;&nbsp;7(1) sentence&nbsp;3 is not a shortcut around the\n            requirements of specific titles.<\/p>\n            <p>In practice, &sect;&nbsp;7(1) sentence&nbsp;3 AufenthG is\n            discussed primarily for internationally mobile private clients,\n            retirees, or persons with international property and asset\n            structures who are planning to relocate or establish a\n            long-term presence in Germany.<\/p>\n\n            <h2 id=\"pp-norm\">What &sect;&nbsp;7(1) Sentence&nbsp;3 AufenthG\n              Enables<\/h2>\n            <p>&sect;&nbsp;7(1) sentence&nbsp;3 AufenthG permits the granting\n            of a residence permit for a purpose not specifically provided for\n            in the Residence Act. The immigration authority exercises\n            discretion and makes a holistic assessment.<\/p>\n            <p>The application must set out clearly why the stay in Germany\n            is sought, why no specific title applies, and why the stay will\n            not burden public funds. Relevant factors include the asset\n            structure, private ties to Germany, health insurance coverage,\n            long-term housing arrangements or property ownership &mdash;\n            which may support plausibility but do not create entitlement\n            &mdash; and a plausible longer-term life plan in Germany.<\/p>\n            <p>There is no checklist that, if completed, automatically leads\n            to a grant. What matters is the persuasive force of the overall\n            picture &mdash; clarified identity, a coherent and plausible\n            purpose of stay, demonstrably secured livelihood, no security\n            concerns, and a comprehensible interest in residing in\n            Germany.<\/p>\n\n            <h2 id=\"pp-livelihood\">Secured Livelihood from Private\n              Means<\/h2>\n            <p>Secured livelihood includes adequate health insurance coverage\n            and must be demonstrated without reliance on public funds. For\n            private individuals without employment, the authority assesses\n            not only account balances but the sustainability of the income\n            and asset structure.<\/p>\n            <p>Lump-sum assets can be relevant but are frequently\n            insufficient on their own unless it is clearly demonstrated how\n            they secure the living costs over the intended period of\n            residence. Regular income streams &mdash; pensions, dividends,\n            rental income, capital returns &mdash; are generally easier to\n            present convincingly in the authority&rsquo;s assessment.<\/p>\n            <p>From practice: the assessment is demanding because income\n            sources often originate abroad and are denominated in foreign\n            currency. Foreign-language documents must generally be\n            accompanied by certified translations. For foreign public\n            documents, land register extracts, or financial statements, an\n            apostille, legalisation, or other authenticity certification\n            may be additionally required. Incomplete documentation is a\n            frequent cause of refusal &mdash; not because the means are\n            absent, but because they are not convincingly evidenced.<\/p>\n\n            <h2 id=\"pp-employment\">No Employment &mdash; What That\n              Means<\/h2>\n            <p>The title will regularly be issued with a condition excluding\n            gainful employment unless employment has been expressly\n            authorised. A residence permit under\n            &sect;&nbsp;7(1) sentence&nbsp;3 AufenthG does not itself\n            authorise gainful employment; employment may only be permitted\n            separately.<\/p>\n            <p>Purely private asset management may be distinguishable from\n            gainful employment. However, active management of a German\n            business, regular commercial activity, operational real estate\n            management or freelance services can cross the line into\n            employment or self-employment and should be assessed before\n            filing. A shareholder who becomes operationally active or acts\n            as managing director may need a different title, especially\n            &sect;&nbsp;21 or &sect;&nbsp;19c AufenthG. The boundary\n            between asset management and gainful employment should be\n            clarified before the application is filed.<\/p>\n            <p>Applicants who may wish to work in Germany at a later stage\n            should address this before the initial application. A change of\n            purpose is generally possible later but involves a new\n            application procedure. It may serve as an indication of a longer-term life plan\n            in Germany and support the plausibility of the stated purpose of\n            stay.<\/p>\n            <p>Before entering into binding purchase, lease, financing or\n            renovation commitments, residence-law timing and conditions\n            should be checked. Tax questions should be assessed separately.\n            We coordinate residence law and contract law in such mandates\n            &mdash; to ensure that the purchase contract and the residence\n            permit do not stand in an unfavourable relationship to each\n            other. Further detail is on our\n            <a href=\"\/en\/contract-law-germany\/\">contract law page<\/a>.<\/p>\n\n            <h2 id=\"pp-settlement\">The Path to a Settlement Permit<\/h2>\n            <p>Periods of residence under &sect;&nbsp;7(1) sentence&nbsp;3\n            may be relevant to future long-term residence, but the\n            settlement permit must be assessed independently and may be\n            difficult for private individuals without employment-related\n            pension contributions.<\/p>\n            <p>The standard settlement permit route under\n            &sect;&nbsp;9 AufenthG requires 60&nbsp;months of statutory\n            pension contributions or evidence of comparable old-age\n            provision, where accepted, together with B1 German, secured\n            livelihood, adequate housing, and no serious criminal\n            convictions. The EU long-term residence permit under\n            &sect;&nbsp;9a AufenthG may in some cases be worth assessing,\n            but it also requires stable and regular resources and an\n            old-age provision assessment under\n            &sect;&nbsp;9c AufenthG. Those still abroad will\n            generally first require a national visa under\n            &sect;&nbsp;6(3) AufenthG. For certain privileged nationalities\n            under &sect;&nbsp;41 AufenthV, an in-country application after\n            visa-free entry may be possible &mdash; the route should be\n            assessed before entry.<\/p>\n            <p>Document preparation is decisive. Beyond identity documents,\n            passports, and photographs, the income evidence forms the core:\n            current and historical bank statements, pension income\n            certificates, asset schedules, rental income documentation,\n            extracts from foreign land registers or securities accounts.\n            Foreign-language documents must be translated; for certain\n            public documents, apostille, legalisation, or sworn translations\n            are required.
